MPD chief says no one is above the law, cites court ruling vs ‘Tokhang’ cop


MANILA, Philippines – Manila Police District (MPD) director Police Brigadier General Vicente Danao on Thursday reminded law enforcers that no one is above the law following the Ombudsman’s decision to dismiss from service a police officer for the death of an epileptic during an anti-drug operation.

The Ombudsman found recently promoted Police Lieutenant Gerry Geñalope guilty of grave misconduct for the death of 23-year-old Djastin Lopez during a drug operation in Tondo, Manila on May 18, 2017.

Lopez suffers from epilepsy and is said to have already surrendered when he was shot dead.

Danao said that they will be following Ombudsman’s order, adding that due process was observed in the investigation of the case.

“The OMB has spoken and we have to implement it,” Danao said.

“In this case It can be pointed out that due process has been observed and fair judgement has been meted out,” Danao added.

Aside from dismissal from service, Geñalope will also be charged with murder.

Danao, however, said that the dismissed police officer can still file an appeal.

“Utmost diligence and upholding the rule of law should always prevail above all,” Danao said. /gsg
