DOJ greenlights Dela Rosa’s arrest after SC rejects TRO plea


MANILA – Law enforcement agencies may proceed with serving the International Criminal Court’s
(ICC) arrest warrant against Senator Ronald “Bato” dela Rosa after the Supreme Court (SC) on Wednesday denied his plea for a temporary restraining order (TRO), Justice Secretary Frederick Vida said Thursday.

Vida said the National Bureau of Investigation (NBI) agents can already pursue their operations “to effect the service of the arrest warrant”.

“First, there's a valid arrest warrant issued by the ICC. Second, he is not in the Senate premises. Third, there's no TRO or any interim order from the Supreme Court. Fourth, the arrest warrant is now enforceable. So, it will be enforced, and it will be served,” he said in a press briefing.

He also said no shortcuts will be taken in serving the warrant.

“(T)here's coordination among the various law enforcement agencies. There are existing guidelines and standard operating procedures to effect the arrest, and all of this will be followed,” he added.

Dela Rosa has been named in the ICC charges for his part as head of the national police in the deadly campaign against illegal drugs of former president Rodrigo Roa Duterte’s administration.

Last Sunday, the Office of the Solicitor General urged the SC to reject Dela Rosa's plea for TRO, saying the country is committed to international law and to holding those responsible accountable.

In a statement, the Philippine National Police (PNP) said it "takes note" of the DOJ directive, stressing that it will follow its mandate “in accordance with due process of the justice system.

“The PNP respects the processes of the justice system and recognizes the authority of competent government agencies in the implementation of lawful orders,” PNP chief Gen. Jose Melencio Nartatez Jr. said.

“As a law enforcement agency, the PNP shall perform its mandate in accordance with existing laws, due process, and established operational procedures,” he added.

For his part, Criminal Investigation and Detection Group (CIDG) director Maj. Gen. Robert Alexander Morico II said that they will implement the arrest warrant against Dela Rosa once the "go signal" is given by Nartatez.

In a phone interview with reporters, Morico said they will expand their resources and manpower as soon as the order to arrest Dela Rosa is given.

"After there is an order already and when the Chief PNP has directed us, we will use the entire CIDG unit from every region and for every province in coordination with other territorial police units," he said.

Respect legal process, Hontiveros tells Bato

Senator Risa Hontiveros, meanwhile, urged Dela Rosa to submit to legal authorities and respect due process.

Reacting to the DOJ's pronouncement, Hontiveros stressed that the rule of law must prevail.

“The rule of law should always prevail. Dapat manaig ang pagrespeto sa batas at prosesong legal (Respect for the law and legal process must prevail),” she said in a statement.

She reiterated her appeal for Dela Rosa to cooperate with authorities and legal institutions.

“Inuulit ko ang aming panawagan kay Senator Dela Rosa: Igalang ang batas, at mag-submit at makipagtulungan sa mga alagad at proseso ng batas (We reiterate our call on Senator Dela Rosa: Respect the law, and submit and cooperate with law enforcers and legal processes),” she said.

Hontiveros also expressed hope for a peaceful resolution of the issue, saying the controversy has already affected multiple institutions and the country as a whole.

“I pray for the peaceful and lawful resolution of this situation, which has already affected multiple institutions, and the entire country itself. May justice be served,” she said. (with reports from Christopher Lloyd Caliwan and Wilnard Bacelonia/PNA)
